| Summary: | The objectives of the paper are to identify the valuation methods used in the assessment of compensation for expropriation of property for a cause d’utilité publique, in France and to analyse the amounts of compensation calculated based the value of land expropriated and the impact on potential diminuition or increases in the value of land retained. The paper is original in this subject area, in that it illustrates the results of primary research from structured interviews using mostly qualitative techniques to provide an incisive and deep understanding of the valuation purpose, process, rationale, opinion and practice in the assessment of compensation and payment of the indemnity. The focus of the interviews is the use of illustrative scenarios containing land values, plans and visual aids and the subject matter is substantially based on transport/infrastructure projects. The application and dissemination of the result of this type of research is particularly appropriate in a geographically expanding Europe with much cross border employment, yet converging professional regulations as exampled by surveying. The work is a departure from the existing knowledge of the subject, which has tended to focus on the comparative analysis of country specific legal literature, particularly statute and expands upon the existing investment valuation knowledge. The analysis in the paper provides links between the valuation process and compliance with the administrative procedure and law and concludes by considering the accepted perception, from beyond the borders of France that generous compensation payments are made in settlement of expropriation so as to be expedient in the completion of a project. |
